Disablement benefit
People in the Netherlands can claim labour disablement benefits according to the Industrial Disablement Act (WAO), the Disablement Provision Act for Disabled from an Early Age (Wajong) and the Disablement Act for Self-employed (WAZ). These acts have been in force since 1 January 1998.
On 1 January 2006, the Act on Work and Income (WIA) was introduced. The WIA covers two regulations, i.e. one for fully disabled (IVA) and one for partially disabled (WGA).
Since 1 January 2004, employees who fell ill on or after this date can no longer claim WAO benefits. Since 1 January 2006 – after their employers have paid their wages during a period of two years – they can apply for WIA benefits. The situation remains unchanged for people who already receive WAO benefits. Due to the after-effects of the WAO, a limited number of new benefits can be granted after 1 January 2004, based on previously acquired rights.
Self-employed who fell ill on or after 1 August 2004, can no longer claim WAZ benefits. The situation remains unchanged for people who already receive WAZ benefits.
